Terms of Service

These Terms of Service ("Terms") govern your access to and use of AgentScout Pro, operated by Taylored Solutions and Outcomes LLC d/b/a AgentScout Pro ("we," "us," or "our") at agentscoutpro.com (the "Service"). These Terms apply to all visitors and users of the Service, whether or not you create an account. By accessing or using the Service, including searching for agents without an account, you agree to these Terms.

1. Description of Service

AgentScout Pro is a recruiting intelligence platform for licensed insurance professionals. The Service provides access to publicly available licensed insurance producer records, contact lookup tools, AI-generated recruiting research, and outreach campaign management via SMS and email.

2. Eligibility

You must be at least 18 years old to use this Service. To create an account, you must be a licensed insurance professional or authorized representative of an insurance agency, IMO, or FMO. By creating an account, you represent that you meet these requirements.

3. Accounts and Credits

You are responsible for maintaining the confidentiality of your account credentials. The Service operates on a credit-based system:

  • Free plan: 500 credits per month, reset monthly
  • Paid plans: credits as described on the billing page, reset monthly
  • One-time top-up packages are available on all plans
  • Credits are non-refundable once used
  • Unused credits do not roll over between billing periods

4. Team Seats and Plan Limits

Each paid plan includes a specified number of team seats that determines how many users may belong to your organization:

  • Free and Starter plans: 1 seat
  • Pro plan: 3 seats
  • Agency, IMO, and Enterprise plans: unlimited seats

If you downgrade to a plan with fewer seats than your current team size, existing team members will retain access to the Service. However, you will not be able to invite new members until your team size is within the seat limit of your current plan.

Seat limits are subject to change. We will notify you of any changes to your plan's seat allocation before they take effect.

5. SMS and Email Outreach Program

AgentScout Pro enables users to send recruiting outreach messages to licensed insurance producers via SMS and email. By using the outreach features, you agree to the following:

Message Frequency

The platform sends up to 3 messages per recipient per campaign: an initial message (Day 1), a follow-up (Day 3), and a closing message (Day 7). Message frequency varies based on the number of campaigns you launch.

Message and Data Rates

Standard message and data rates may apply to recipients based on their carrier plan. AgentScout Pro is not responsible for carrier charges incurred by message recipients.

Opt-Out

Every SMS message sent through AgentScout Pro includes opt-out instructions. Recipients may reply STOP at any time to be removed from all future messages. Recipients who reply STOP are immediately added to a Do Not Contact list. To get help, recipients may reply HELP.

User Responsibility

You are solely responsible for ensuring your outreach complies with applicable laws, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act. AgentScout Pro provides compliance tools (Do Not Contact lists, opt-out handling) but does not guarantee legal compliance on your behalf.

6. Acceptable Use Policy

You agree not to use the Service to:

  • Send unsolicited commercial messages unrelated to insurance recruiting
  • Harass, threaten, intimidate, or send spam beyond legitimate B2B recruiting outreach
  • Violate any applicable federal, state, or local law or regulation
  • Scrape, resell, redistribute, or commercially exploit producer data outside the platform
  • Perform automated bulk downloads or data extraction beyond published API rate limits
  • Circumvent any technical restrictions, access controls, or rate limits
  • Use the outreach tools for purposes unrelated to insurance producer recruiting
  • Share API keys, access tokens, or account credentials with unauthorized parties
  • Use the Service for consumer credit reporting purposes

Violation of this Acceptable Use Policy may result in immediate account suspension or termination, at our sole discretion, with or without prior notice.

7. Payments and Refunds

Payments are processed by Stripe. Subscription fees are billed monthly and are non-refundable except as required by law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Top-up credit purchases are non-refundable.

8. Intellectual Property

AgentScout Pro and its original content, features, and functionality are owned by Taylored Solutions and Outcomes LLC d/b/a AgentScout Pro and are protected by applicable intellectual property laws. Producer data displayed on the platform is sourced from publicly available government records and is not our proprietary information.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that contact information found through the Service is accurate, current, or complete. We do not guarantee any recruiting outcomes or results.

10. Limitation of Liability

To the maximum extent permitted by law, AgentScout Pro shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to TCPA violations resulting from your outreach campaigns. Our total liability to you shall not exceed the amount you paid us in the three months preceding the claim.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

12. White Label and Data Processing

AgentScout Pro offers white label solutions that allow Independent Marketing Organizations (IMOs) and other enterprise partners to operate the Service under their own brand.

  • When an IMO uses AgentScout Pro under their brand, AgentScout Pro acts as a data processor on behalf of the IMO.
  • The IMO serves as the data controller for their agents' usage of the white-labeled platform.
  • Data isolation between organizations is enforced through row-level security policies at the database level. No organization can access another organization's data.
  • A Data Processing Addendum (DPA) is available upon request for enterprise partners who require formal data processing agreements. Contact support@agentscoutpro.com to request a DPA.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
